Terms of Service and Conditions of Sale

These Terms of Service and Conditions of Sale govern access to and use of the Lobo Apparel online store, available at www.loboapparel.pt, as well as all purchases made through the website.
The online store is operated by:

By accessing or using the website or placing an order, you acknowledge that you have read and understood these Terms, our Privacy Policy, our Returns, Exchanges and Refunds Policy and any other policies applicable to your purchase.
1. Scope
These Terms apply to:
- Access to and use of www.loboapparel.pt;
- The creation and use of customer accounts;
- Purchases made through the online store;
- Payments, deliveries, returns, exchanges and refunds;
- The use of the website’s content, tools and features.
For purchases made by consumers, nothing in these Terms limits or excludes any mandatory rights granted under Portuguese law or other applicable consumer-protection legislation.
2. Capacity to enter into a contract
To place an order, you must have the legal capacity to enter into a binding contract.
Where a purchase is made on behalf of a company or another organisation, the person placing the order represents that they have sufficient authority to bind that organisation.
Consumer-protection provisions may not apply where a purchase is made for business, commercial, craft or professional purposes.
3. Use of the online store
You must use the website lawfully, responsibly and in accordance with these Terms.
You must not:
- Use the website for unlawful, misleading or fraudulent purposes;
- Provide false information or impersonate another person;
- Use another person’s account or payment method without authorisation;
- Attempt to access accounts, systems or personal data without authorisation;
- Introduce viruses, malicious software or other harmful code;
- Interfere with the security, integrity or operation of the store;
- Collect data through automated methods without prior authorisation;
- Copy or commercially exploit Lobo Apparel content without permission;
- Use the store for unauthorised resale or abusive commercial activity.
Lobo Apparel may restrict or suspend access where a user breaches these Terms or uses the website in a fraudulent, abusive or harmful manner.
4. Customer accounts
Certain website features may allow you to create a customer account.
You are responsible for:
- Providing complete, accurate and up-to-date information;
- Keeping your account details correct;
- Protecting your password and login credentials;
- Not sharing your login details with third parties;
- Informing us of any suspected unauthorised use of your account.
You are responsible for activities performed through your account unless the unauthorised use is not attributable to you.
Lobo Apparel may suspend or close an account where there are reasonable indications of fraud, abuse, security risks or a breach of these Terms.
5. Products and product information
Lobo Apparel aims to provide complete and accurate information about its products, including:
- Photographs;
- Descriptions;
- Materials;
- Colours;
- Sizes;
- Product characteristics;
- Care instructions;
- Availability.
Minor differences may exist between the images displayed and the actual product due to:
- Screen or device settings;
- Lighting used in photography;
- Natural characteristics of the materials;
- Minor manufacturing variations.
These differences do not affect the consumer’s rights where the product received does not objectively correspond to the description, agreed characteristics or qualities that may reasonably be expected.
Measurements and size guides are provided for guidance. Customers should review the information relating to each product before placing an order.
6. Product availability
All products are subject to stock availability.
Adding a product to the shopping basket does not reserve the product or guarantee its availability until the order has been successfully completed.
In exceptional circumstances, an item displayed as available may become unavailable before the order is processed.
Where an ordered product is unavailable, Lobo Apparel will inform the customer and refund the amount paid for that product through the original payment method.
7. Prices
Prices are displayed in euros unless otherwise stated.
Prices offered to consumers include VAT at the applicable legal rate where VAT is due.
Delivery costs, customs duties and other charges not included in the product price will be displayed separately or communicated before the order is completed where they are charged by Lobo Apparel.
Customers may be responsible for customs duties, import taxes or other charges imposed in the destination country where these amounts are not collected at checkout.
Lobo Apparel may change prices at any time. Price changes will not affect orders that have already been confirmed, except in cases of an obvious error that a reasonable customer could recognise.
8. Pricing or information errors
Although we take reasonable care to ensure accuracy, technical, typographical, descriptive or pricing errors may occur.
Where an error is identified before dispatch, the customer will be informed and may:
- Confirm the order at the correct price or under the correct conditions; or
- Cancel the order and receive a full refund.
Lobo Apparel is not required to supply a product at a manifestly incorrect price where the error is obvious and could reasonably have been recognised as an error.
This provision does not limit mandatory consumer rights or permit the unilateral alteration of a validly concluded purchase contract.
9. Placing an order
To place an order, the customer must:
- Select the desired products;
- Add the products to the shopping basket;
- Confirm the products, quantities, sizes and other options;
- Provide the requested billing and delivery information;
- Select the available delivery and payment methods;
- Review the order information;
- Accept the applicable terms and policies;
- Confirm the purchase through the button indicating an obligation to pay.
Customers should carefully review all information before submitting the order, particularly the products, sizes, quantities, delivery address and contact details.
10. Order confirmation and contract formation
After placing an order, the customer will receive an electronic acknowledgement confirming that the order has been received.
An automated acknowledgement does not necessarily confirm that every product is available or that the order has been dispatched.
The purchase contract is concluded when Lobo Apparel accepts the order and sends the relevant confirmation or begins dispatching the products.
Lobo Apparel may decline or cancel an order before dispatch where there is:
- A lack of stock;
- An obvious pricing or product-description error;
- A failure to authorise or confirm payment;
- Incomplete or incorrect delivery information;
- A reasonable suspicion of fraud or unauthorised activity;
- A breach of these Terms;
- A legal or logistical inability to complete the order.
Where Lobo Apparel cancels a paid order, all applicable amounts received will be refunded without undue delay.
11. Payments
Customers may use the payment methods displayed at checkout at the time of purchase.
Payments may be processed by Shopify, financial institutions or external payment-service providers.
Lobo Apparel does not normally receive or store complete payment-card details.
The customer represents that:
- They are authorised to use the selected payment method;
- The payment information provided is correct;
- Sufficient funds or credit are available to complete the transaction.
An order may not be processed until payment has been authorised or confirmed.
Certain payment methods may also be subject to the terms and conditions of the relevant payment provider.
12. Security and fraud prevention
Lobo Apparel and its service providers may carry out checks to:
- Confirm the customer’s identity;
- Validate the selected payment method;
- Detect suspicious transactions;
- Prevent fraud and misuse;
- Protect customers, Lobo Apparel and third parties.
Additional information may be requested where reasonably necessary to verify the legitimacy of a transaction.
An order may be suspended or cancelled where there are reasonable indications of fraud or unauthorised use of a payment method.
13. Delivery
Orders will be delivered to the address provided by the customer during checkout.
The customer is responsible for ensuring that:
- The delivery address is complete and correct;
- The recipient’s name is properly stated;
- Someone is available to receive or collect the order where necessary.
Delivery times are estimates and may vary depending on:
- The destination;
- The carrier;
- Product availability;
- Promotional periods;
- Public holidays;
- Customs procedures;
- Events outside Lobo Apparel’s reasonable control.

14. Transfer of risk
For purchases made by consumers, the risk of loss or damage passes to the customer when the customer, or a third party appointed by the customer other than the carrier, takes physical possession of the goods.
Where the consumer directly appoints a carrier that was not offered by Lobo Apparel, the risk may pass when the goods are handed to that carrier, in accordance with applicable law.
15. Undelivered or uncollected orders
Where an order cannot be delivered because of:
- An incorrect or incomplete address;
- The recipient’s repeated absence;
- Failure to collect the parcel within the stated period;
- Unjustified refusal of delivery;
the order may be returned to Lobo Apparel.
The customer may be responsible for the actual return or redelivery costs, to the extent permitted by law.
This does not apply where the delivery failure is attributable to Lobo Apparel or to a carrier appointed by Lobo Apparel.
16. Cancellations, returns and exchanges
Consumers may exercise their statutory right of withdrawal within 14 calendar days, without providing a reason.
Requests may be submitted through the electronic withdrawal button available in the website footer or by contacting lobo@loboapparel.pt.

- Condition of returned items;
- Return shipping costs;
- Exchanges;
- Refunds;
- Promotional items;
- Products excluded from the right of withdrawal.
17. Conformity and statutory guarantee
Products sold by Lobo Apparel must correspond to:
- Their description;
- The agreed characteristics;
- The expected quantity and quality;
- The normal use of goods of the same type;
- Public statements and information provided before purchase.
Under Portuguese law, new movable goods generally benefit from a three-year statutory conformity guarantee beginning on the date of delivery.
Where a lack of conformity becomes apparent within the first 30 days following delivery, the consumer may request immediate replacement of the product or termination of the contract, subject to the applicable statutory conditions.
Depending on the circumstances and legal requirements, consumers may otherwise be entitled to:
- Repair;
- Replacement;
- A proportionate reduction in price;
- Termination of the contract.
Remedies will be provided free of charge, within a reasonable period and without significant inconvenience to the consumer, in accordance with applicable law.
The statutory guarantee does not cover problems caused exclusively by:
- Normal wear and tear;
- Improper or excessive use;
- Accidents;
- Alterations carried out by the customer or third parties;
- Washing or maintenance contrary to the product instructions;
- Damage occurring after delivery.
These exclusions only apply where the damage is connected to the customer’s use, handling or conduct.
18. Promotions and discount codes
Campaigns, promotions and discount codes may be subject to specific conditions, including:
- Expiry dates;
- Eligible products;
- Minimum purchase amounts;
- Usage limits;
- Product exclusions;
- Restrictions on combining promotions.
The applicable conditions will be communicated together with the relevant promotion.
Unless otherwise stated, discount codes:
- Cannot be exchanged for cash;
- Cannot be used after their expiry date;
- Cannot be applied retrospectively to completed purchases;
- Cannot be combined with other discount codes.
Promotional products retain the statutory conformity, return and refund rights applicable to consumers.
19. Intellectual property
All elements of the website, including:
- Trademarks and logos;
- Photographs and videos;
- Text and product descriptions;
- Illustrations and designs;
- Graphics and catalogues;
- The structure and presentation of the website;
- Software and code;
belong to Lobo Apparel, SUMMER IN JUNGLE – UNIPESSOAL, LDA. or their respective owners and are protected by applicable intellectual-property legislation.
Access to or use of the website does not transfer any intellectual-property rights to the user.
Website content may not be copied, reproduced, modified, distributed, published or commercially exploited without prior written permission, except where permitted by law.
20. Reviews and user-submitted content
Where the website allows users to publish reviews, comments, images or other content, the user represents that:
- The content is truthful and lawful;
- They have the necessary rights to submit it;
- It does not infringe the rights of third parties;
- It is not offensive, discriminatory, threatening or defamatory;
- It does not contain unsolicited advertising or fraudulent content;
- It does not contain viruses, malicious code or harmful material.
Lobo Apparel may moderate or remove content that breaches these Terms, subject to applicable law.
By submitting content for publication, the user grants Lobo Apparel a non-exclusive and royalty-free permission to display and reproduce that content on the website and related brand channels, to the extent necessary and permitted by law.
21. Third-party services and links
The website may contain links to or integrations with external services, including:
- Shopify;
- Payment providers;
- Carriers and logistics providers;
- Social networks;
- Analytics platforms;
- Third-party applications.
Those services may be subject to their own terms, conditions and privacy policies.
A link or integration does not mean that Lobo Apparel controls or accepts responsibility for the practices, content or availability of third-party services.
Shopify provides the technical infrastructure for the store but is not the seller of the products. The purchase contract is concluded between the customer and SUMMER IN JUNGLE – UNIPESSOAL, LDA.
22. Website availability
Lobo Apparel aims to keep the online store available, secure and updated.
However, we do not guarantee that the website will always be available or free from:
- Interruptions;
- Technical failures;
- Errors or inaccuracies;
- Delays;
- Compatibility issues;
- Cyberattacks or events outside our reasonable control.
The store may be temporarily suspended for maintenance, security, updates or technical work.
Reasonable measures will be taken to minimise disruption where possible.
23. Limitation of liability
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including liability for:
- Fraud or wilful misconduct;
- Legally attributable death or personal injury;
- Breaches of mandatory consumer rights;
- Lack of conformity of the products;
- Other situations where exclusion is prohibited by law.
To the fullest extent permitted by law, Lobo Apparel is not liable for losses caused by:
- Misuse of the website or products;
- Failure to follow use, cleaning or care instructions;
- Incorrect information supplied by the customer;
- Third-party services, platforms or content;
- Events or disruption outside its reasonable control.
For business customers, liability for indirect loss, loss of profits, loss of revenue or loss of opportunity may be limited to the extent permitted by law.
Nothing in this section limits the mandatory rights of consumers.
24. Events outside our control
Lobo Apparel is not responsible for delays or failures caused by events outside its reasonable control, including:
- Natural disasters;
- Fire or flooding;
- War, terrorism or civil unrest;
- Strikes or industrial disputes;
- Pandemics or public-health emergencies;
- Transport disruption;
- Widespread power or telecommunications failures;
- Government restrictions;
- Customs disruption;
- Serious failures involving suppliers or carriers.
Where such circumstances affect an order, the customer will be informed as soon as reasonably possible.
The consumer’s statutory rights in cases of impossibility of performance or excessive delay remain unaffected.
25. Personal data
Personal data is processed in accordance with the Lobo Apparel Privacy Policy.
The Privacy Policy explains:
- What personal data is collected;
- How and why it is used;
- Who it may be shared with;
- How long it may be retained;
- The rights available to data subjects;
- How those rights may be exercised.

27. Alternative dispute resolution
In the event of a consumer dispute, the consumer may refer the matter to an approved consumer Alternative Dispute Resolution body.

Consumers may consult the updated list of approved Alternative Dispute Resolution bodies published by the Portuguese Directorate-General for Consumers.
Using an Alternative Dispute Resolution body does not prevent the consumer from bringing a claim before the competent courts.
28. Governing law and jurisdiction
These Terms are governed by Portuguese law.
Where the customer is a consumer residing in another country, this choice of law does not deprive the consumer of the protection granted by mandatory provisions of the law of their country of residence where applicable.
Any dispute will be submitted to the courts having jurisdiction under the applicable legal rules, without prejudice to the availability of alternative dispute-resolution mechanisms.
29. Changes to these Terms
Lobo Apparel may update these Terms to reflect:
- Legal or regulatory changes;
- Changes to the operation of the online store;
- New payment or delivery methods;
- Changes to products or services;
- Technical or security requirements.
The updated version will be published on the website together with the relevant update date.
Changes will not affect orders that have already been completed unless required by law or expressly accepted by the customer.
30. Severability
If any provision of these Terms is found to be invalid, unlawful or unenforceable, the remaining provisions will remain in full force.
The affected provision will be interpreted or replaced, to the extent legally possible, by a valid provision that most closely reflects its original purpose.
31. No waiver
A failure or delay by Lobo Apparel in exercising any right does not constitute a waiver of that right.
Any waiver must be made expressly.
32. Language
These Terms may be made available in Portuguese and English.
Both versions are intended to communicate the same content. In the event of a discrepancy, the Portuguese version will prevail to the extent permitted by applicable law and without prejudice to mandatory consumer rights.
